Department of Employee Relations
For employees with family coverage, coverage for health and/or dental will continue and the employee share will be covered by the City. For those with single coverage, coverage will end while an employee is on active leave, but will be reinstated the day the employee returns to work. The employee must resubmit a health and/or dental enrollment form for employee coverage when they return to work.
Coverage will continue for a maximum of 12 months while the employee is on military leave as long as the employee pays the premiums. At the end of 12 months coverage will end but will be reinstated the day you return to work. If premium payments are not made coverage will end but will be reinstated the day you return to work.
Chapter 36 of the City charter provides that service credit for pension purposes will continue to accrue while on an approved military leave of absence from the date the leave begins up to a maximum of 90 days after the military discharge date. Contributions are required from the agency during this time period to reflect the salary the employee would have earned had they not been on military leave. For pension purposes, it will appear there was no break in service for military leave.
A participant’s 457 account is not frozen while on active leave. Accounts remain active and allocation changes can be made at anytime. Participants can only contribute when they are receiving pay from the City. Once participants return from military leave, they may restart deferrals.
Sick leave and vacation are frozen when a member is off the City payroll. The member does not lose any sick leave or vacation and does not accrue any sick leave or vacation while they are off payroll. Where provisions of an applicable labor contract differ from this policy, benefits are administered per the labor contract.
The Family Medical Leave Act (FMLA) allows employees to take time off work for their own serious health condition or to care for a family member. Additional information regarding FMLA eligibility and benefits can be found in the link below.
Members must notify the FPC upon return if eligible and interested in taking promotional examinations.
