MPD policy does not provide for appropriate oversight and require IAD to assess whether a complaint should be investigated by a district or by IAD.
MPD should require that all complaints are sent to IAD for review and determination for appropriate assignment.
Standard Operating Procedure (SOP) 450.10 (J) – Personnel Investigations details proper procedures regarding personnel investigations and requires all citizen complaints to be reviewed by the commanding officer, or designee, of the Internal Affairs Division to determine if the complaint will be handled by a supervisor at the district station or an investigator assigned to the Internal Affairs Division.
Complaints involving supervisors and/or more than one district or bureau are normally retained at IAD. With a few rare exceptions, “sensitive” investigations such as harassment or discrimination complaints are also retained at IAD. A member’s disciplinary history is also taken into consideration prior to determining the direction for a current investigation.
The department will modify the forms associated with internal investigations by removing the check box that allows work location commanders to investigate some internal complaints at the work location, and this modification will require IAD to review all internal and external complaints and determine who will conduct the investigation.
