IMPLEMENTATION AND ENFORCEMENT STATUS (Paid Sick Leave Ordinance):

On March 24, 2011, the Court of Appeals reversed and remanded the Milwaukee County Circuit Court's injunction on the implementation and enforcement of Milwaukee's Paid Sick Leave Ordinance.  The decision orders the Circuit Court to grant summary judgment in favor of 9 to 5 National Association of Working Women and to vacate the injunction.  The Paid Sick Leave Ordinance cannot be implemented and enforced until the Circuit Court vacates the injunction, which cannot occur until at least 31 days after the date of the Court of Appeals decision.  That period may be extended if the Metropolitan Milwaukee Association of Commerce files a motion to reconsider or a petition for review by the Wisconsin Supreme Court.

The Equal Rights Commission considered the revised Paid Sick Leave Ordinance Administrative Rules at its meeting on May 19, 2010.  Changes to the Administrative Rules issued in April of 2009 have been made based on comments, questions, and feedback received by the Commission since the release of the original rules.  Please forward specific questions or concerns to Maria Monteagudo at mmonte@milwaukee.gov
